GAMR – Halts Gruesome Death March with a Tiger in Its Tank? Up 43% Since Spotlight — EMIS – Looking for Signs of Life and Finding Trading Range

Thursday, October 7th, 2010

StockGuru Spotlight October 7, 2010

VSUL, OOIL, SOKF, ALIF, CFWH, SGYP, NUIN

Dear Members:

StockGuru makes contrarian picks all the time.  For bio-tech and bio-pharma these picks are generally associated with a setback in research.  We have one bio-tech and one auction company.  The auction company defies understanding in as much as auctioning bankrupt companies ought to be a great business now.  Apparently, that’s what Elliott LP thought as well.

EMIS skipped the death sprial and just jumped off a cliff.  This Company has a market cap of $52M and averaging 273,000 shares a day.  They have announced that further data will be forthcoming in Q4 2010.  Without positive data, this Company is in a holding pattern notwithstanding the underlying reality that they have taken all the RIGHT steps to stem the tide in terms of price erosion.  These appear to be pretty sophisticated communications experts in addition to serious researchers.  The data just did not work out in one segment of their research.  However, there are other study areas and phases with potential.  Do not count these guys out yet.  Definitely watch for signs of life.  They filed an S-1 on September 15.  In these small companies checking their cash flow is crucial.  They have $3.5M in warrants exercisable $1.26 per share for 5 years from the date of issuance.  They can overcome this and they have money to move forward, it looks like, but without news they are most likely capped at $1.25.  I would like to see them come out with information regarding the Q4 data sooner, rather than later.  Obviously, the Q4 clock is running.

GAMR is non-bio-tech Company trying to pull out of a death spiral with a little help from a friend.  In a backward world, they would have a perfect chart, down.  It looks like they have finally hit bottom and are bouncing up, at least for air.  StockGuru Spotlighted this Company fairly close to the bottom of a long relentless descent downward.  Effective September 14, 2010, Harvey M. Yellen was appointed by the board of directors of Great American Group, Inc. as the Chief Operating Officer; he is from  Louisiana State University, Go Tigers, because it will take a Tiger to make this work. Their market cap is down to $15M and their volume is bouncing around at 23M (but remember that volume number includes the Elliott LLP purchase so it is skewed).  Either Yellen pulls this out with more business (and a little help from Elliott LP) or he does not.  Watch this Company.

For GAMR either way, if you have watched our Spotlights you have made some money with this struggling company.

We have triple digit winners every day, but here is where you find triple digit winners in the making:

EMIS STOCKGURU SPOTLIGHT August 7, 2010 at $0.88

Looking for Q4 2010 Data with Treatment of Osteoporosis is Planned to Be Filed during 2011

Biopharma’s miss their target dates all the time and that is reasonable and understandable.  They are working in an unknown realm.  That being said, it is important to begin to watch for the announced Q4 Data or a revised timeline.  If you get neither a revised timeline or the announced Q4 Data, then this company can no longer be considered a hold.  These guys have done everything possible, they presented at the Rodman & Renshaw’s 12th Annual Healthcare Conference and put out a paid for research report.  They really are doing all the can, short of producing results and that’s what must come next for this company to move.  Who knows where they would be without the Healthcare Conference presentation.  The paid for research probably made THEM feel better.  I would have liked to have heard that discussion.

On August 18, 2010, this was a StockGuru Contrarian pick at $0.88.  While this is not a bad company, it has had some poor results.

Emisphere Technologies, Inc. (OTCBB:EMIS) is a biopharmaceutical company that focuses on the unique and improved delivery of therapeutic molecules or nutritional supplements using its proprietary Eligen(R) Technology. The Eligen(R) Technology can be applied to the oral route of administration as well as other delivery pathways such as buccal, rectal, inhalation, intra-vaginal or transdermal. On July 23, the Company announced that Novartis Pharma AG and its license partner Nordic Bioscience a/s (the “Sponsor”) have reported an independent Data Monitoring Committee (“DMC”) conducted a futility analysis of one-year data for all patients enrolled in this two-year study, including assessments of safety and efficacy parameters. The DMC concluded that although there is no reason to stop Study 2302 because of safety concerns, there is no reason to continue the study for efficacy. The DMC also concluded that the final decision whether to continue Study 2302 rests with the Sponsor. This study incorporates Emisphere’s unique and proprietary Eligen(R) Drug Delivery Technology for the improved oral absorption of salmon calcitonin.

However, it is important to note that a parallel two-year Phase III Study 2301 in osteoarthritis assessing the safety and efficacy of oral calcitonin in the treatment of osteoarthritis of the knee is still in progress. In December 2009, the DMC conducted a futility analysis of one-year data for all patients enrolled in this two-year study, including assessments of safety and efficacy parameters, and recommended to continue with such Study.

The Sponsor currently intends to continue the clinical program of oral calcitonin in osteoarthritis, including both Phase III Study 2301 and Phase III Study 2302. Novartis and Nordic Bioscience will continue to work together to assess next steps once the final data of Study 2301 is available. This data is expected to be available in 4Q-2010. Additionally, the Sponsor currently intends to continue the clinical program of oral calcitonin in osteoporosis. Previously, in its quarterly earnings report for the period ended June 30, 2010, Novartis stated that oral calcitonin for the treatment of osteoporosis is planned to file with the regulatory authorities during 2011.

On August 25, 2010, EMIS entered into a Securities Purchase Agreement (the “Securities Purchase Agreement”) for 3,497,528 shares of common stock and warrants to purchase a total of 2,623,146 shares of common stock for gross proceeds from the exercise of the warrants of $3,532,503 (the “Private Placement”). Each unit, consisting of one share of common stock and a warrant to purchase 0.75 shares of common stock, was sold at a purchase price of $1.01. The warrants are exercisable at an exercise price of $1.26 per share beginning immediately after issuance and expire 5 years from the date of issuance.

GAMR – Stunning Come Back?
Can the 11% Rise Yesterday and the 43% Rise Since Spotlight Be Sustained?

Looks like Elliott International, LP became a major holder with that September volume acquiring 2.1M shares.  Elliott International, L.P. is a fund family of Elliott Management Corporation specializing in investments in distressed companies, such as those in bankruptcy, undergoing reorganization or corporate restructuring. The funds primary focus is on stocks and it also invests in bonds, foreign exchange, warrants, options, and futures.  Maybe they are Mr. Yellen’s Tiger helper.

What is the StockGuru Spotlight?

The StockGuru Spotlight features stocks that we expect some action in. Generally speaking we expect a strong showing in the market based on the market, our knowledge of the stock and the buzz in the markets. Many times these will be stocks that have big news out recently, there is fresh interest in getting the word out on these stocks or we hear a buzz in our day to day contacts on these stocks. If we think it is going to move or see action, we put it in the StockGuru Spotlight.  If we are compensated for a stock in the Spotlight, it will be clearly disclosed within this Spotlight Announcement.
